The petitioner has preferred the present writ petition alleging inaction on the part of the respondent authorities in not considering the petitioner's application for transfer dated 13.07.2022 from Raichenga Vidya Niketan High School (H.S.), Raichenga, Falakata, Dist. Alipurduar. 3.

It is the case of the petitioner that she was appointed as an Assistant Teacher in Political Science (H/PG) under General category vide appointment letter dated 08.07.2011 at Raichenga Vidya Niketan High School (H.S.), Raichenga, Falakata, Dist. Alipurduar. The petitioner submits that she is residing at Jalpaiguri district and she needs to travel 62.1 kilometers every day to reach her working place. She is facing serious gynecological disorders and hence, it is difficult for her to commute 124 kilometers to and fro on a daily basis. In view thereof, she applied for transfer through Online mode vide applications dated 06.08.2021, 12.08.2021, 23.09.2021

and 12.07.2022 respectively from Raichenga Vidya Niketan High School (H.S.), Raichenga, Falakata, Dist. Alipurduar to a nearby school. All these applications were rejected. The petitioner had fallen ill and due to her serious medical condition, she applied for transfer again on 13.07.2022. The said application had reached the West Bengal Central School Service Commission on 27.10.2022. However, till date, no decision has been taken on the aforesaid application of the petitioner.

Learned Advocate for the respondent-West Bengal Central School Service Commission submits that the competent authority has no objection in considering the application of the petitioner dated 13.07.2022 in accordance with law.

In view of the submission made by the learned Advocate for the respondent-West Bengal Central School Service Commission, learned counsel for the petitioner submits that his client shall be satisfied if the application dated 13.07.2022 is decided in a time bound manner by the competent authority.

Accordingly, this Court directs the Secretary, West Bengal Central School Service Commission (respondent no.4) to consider and decide the application of the petitioner dated 13.07.2022 in accordance with law and in terms of the relevant rules, by passing a speaking order within a period of eight weeks from the date of communication of this order after affording an opportunity of personal hearing to the petitioner.

Needless to mention that this Court has not expressed any opinion on the merits of the claim of the petitioner and all issues are left open to be decided by the competent authority in accordance with law.

With the aforesaid directions, the present writ petition is disposed of.

Since no affidavits have been filed by the respondents, the allegations made in the writ petition shall not be deemed to have been admitted.
