Heard learned counsel appearing for the petitioners and learned counsel for the State. The petitioners are casual workers (Group-D staff) under the Jalpaiguri Municipality.

The petitioners seek benefit of a Memo No.1107-F(P) dated Howrah, the 25th February, 2016, issued by Finance Department, Government of West Bengal.

Mr. Deb Barman, learned counsel appearing for the petitioners, submits that the petitioners will make a comprehensive representation before the Chairman, Jalpaiguri Municipality for extending the benefits under the said Government Notification to the petitioners. Mr. Bikramaditya Ghosh, learned counsel for the respondents, submits that the aforesaid memo is not applicable to the employees/workers of a Municipality.

In view of the submissions made by the parties, I feel it appropriate to direct the writ petitioners to make a comprehensive representation before the respondent no.3 within a period of two weeks from date. If such representation is made, the respondent no.3 will consider the said representation and pass a reasoned order with regard to the grant of benefit of the aforesaid Memo No.1107-F(P) dated Howrah, the 25th February, 2016, issued by the Finance Department, Government of West Bengal to the petitioners. The said order should be passed within a period of four weeks from the date of receipt of the aforesaid representation and the same should be communicated to the petitioners within a week from the date of passing such order.

The writ petitioner being WPA 578 of 2020 is disposed of without any order as to costs.
