CIRCUIT BENCH AT JALPAIGURI APPELLATE SIDE 27.02.2023. C.R.M. (NDPS) 215 of 2023 82/tkm In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Matigara P.S case no.815 of 2022 dated 21.7.2022 under sections 21(c) of the NDPS Act.

Petitioner is in custody for more than 200 days. He submits that recovery was contrary to law. He prays for bail. Learned lawyer for the State opposes the bail prayer. We have considered the materials on record. Petitioner did not have valid licence to deal in medicine containing codeine phosphate.

Under such circumstances and in view of the statutory restrictions under section 37 of the NDPS Act we are not inclined to grant bail to the petitioner.

Accordingly, prayer for bail is rejected.
