The petitioner is apprehending arrest in connection with G.R. Case No. 5496 arising out of Dhupguri Police Station Case No. 487 of 2020 dated 20.12.2020 alleging offence under Section 354C/376 IPC now pending in the Court of learned Chief Judicial Magistrate. Our attention is invited to the written complaint to contend that it is the case that the victim lady was found in compromising situation with the petitioner accused when her daughter found the situation and complained to her father.

Having considered the Case Diary in particular the statement of the victim lady recorded under Section 164 Cr.P.C.

before the learned Magistrate, we are not convinced of the submissions made on behalf of the petitioner. Accordingly, the prayer for anticipatory bail is refused. Thus, the application being CRM 249 of 2021 is disposed of.
