For the State The petitioner complains that the Public Health Engineering Department has set up a pump in the land bearing L.R. Plot No. 1485, Khatian No. 77, Mouza-Jamaldaha Balapukuri which is recorded in his name. The petitioner claims absolute ownership of the aforesaid plot.

The petitioner applied before the respondent authorities for seeking information as to whether the pump has been set up on the land in question after proper acquisition.

The petitioner complains that his query has not been answered and the required information has not been provided to him.

Learned Advocate appearing on behalf of the State respondents submits that the petitioner applied before the inappropriate authority. The authority before which the petitioner applied for taking information is not the State Public Information Officer and accordingly, the information could not be communicated to the petitioner.

Be that as it may, the instant writ petition is disposed of by directing the Special Land Acquisition Officer and Collector, Cooch Behar being the respondent No. 7 herein to inform the petitioner whether the land, description of which is appearing hereinabove, has been acquired for the purpose of setting up the pump. The said respondent shall also intimate the petitioner about the department responsible for setting up the pump in the land, ownership of which has been claimed by the petitioner.

The aforesaid information shall be supplied to the petitioner within a period of six weeks from the date of communication of a copy of this order.

The writ petition is disposed of.

Urgent certified photostat copy of this order, if applied for, be supplied to the parties upon observance of requisite formalities.
