Affidavit of service filed by the petitioners is taken on record.
The petitioners are engaged as Community Health Trained Dai and All-time Vaccine Delivery under the Block Medical Officer of Health in different blocks in the district of Alipurduar. The petitioners have been receiving remuneration for work to the tune of a paltry sum of Rs.400/- per month which has not been enhanced since their joining the post till date.
The petitioners are also not being paid their current monthly remuneration for the last six months by the authority.
The petitioners seek to submit a joint comprehensive representation ventilating their grievance before the concerned authority and pray for direction upon the concerned authority to consider the representation at the earliest.
Learned counsel for the State respondents submits that the 2nd respondent be directed to consider the representation submitted by the petitioner, in accordance with law.
Learned counsel for the respondents further submits that they have to ascertain as to whether remuneration is due and payable to the petitioners. In view of the above, the writ petition is disposed of with liberty to the petitioners to submit a comprehensive representation before the concerned authority within 7 days from date. The 2nd respondent is directed to consider and dispose of the representation within two months from the date of receipt thereof after granting reasonable opportunity of hearing to all the interested persons including the petitioners, in accordance with law. The concerned authority shall disburse the current remuneration to the petitioners, if not disbursed earlier, within one month from date. The decision taken by the authority shall be communicated to the petitioners within a week thereof.
With the above observations and directions the writ petition being WPA 393 of 2023 is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted.
