Case No. 157 of 2018 corresponding to Dinhata Police Station Case No. 155 of 2018 dated 12.4.2018 under Sections 147/148/149/427/326/302/10 2(B) of the Indian Penal Code. Copy of the said application has been served upon the learned Counsel appearing on behalf of the State. It is submitted on behalf of the petitioner that the incident occurred on 11th April, 2018 and the FIR was lodged on the next date i.e. on 12th April,. 2018. After conclusion of the investigation, Police submitted charge sheet on 19th March, 2021.

It is further alleged that the case is pending since then before the Magistrate concerned for service of the copy of paper under Section 207 of the Cr.P.C. and for commitment. He further submits that the Court below has fixed the next date on 21st July, 2025.

date and for which the Court below could neither serve copy to the accused persons nor committed the case before the Sessions Court and the proceeding is delayed day by day.

Learned Counsel appearing on behalf of the State submits that if any direction is passed upon the Court below securing attendance of the accused persons on the next date of hearing, the State will serve copy to the accused persons and the case may be committed before the Sessions Court.

Having heard learned Counsel appearing on behalf of both the parties and considering the fact that the prayer made on behalf of the petitioner is innocuous and is required to be allowed for the ends of justice, C.R.R. 96 of 2025 is hereby disposed of with a direction upon the Court below to make necessary direction for securing attendance of all the accused persons on the next date of hearing i.e. on 21st July, 2025 and he is further directed to make every endeavour for service of copy and to take next course of action, preferably within a period of sixty days from the next date.
