This is an application under Article 226 of the Constitution of India wherein the writ petitioners are aggrieved by the inaction on the part of the respondent authorities in not considering the prayer of the petitioners for enhancement of the remuneration at per with the other employees as made under Memo No. 3998-F(P2) dated July 15, 2019.

Mr. Ekramul Bari, learned Counsel appearing on behalf of the petitioners relies on a Memo No. 684 dated October 10, 2012 issued by the District Magistrate, Jalpaiguri to the Principal Secretary, Health and Family Welfare Department, Government of West Bengal. I have heard learned Counsel appearing on behalf of the parties and perused the materials placed on record. After having heard the learned Counsel for the parties, I direct the Principal Secretary, Health and Family Welfare Department, Government of West Bengal, to take

a decision for enhancement of the remuneration of the petitioners at per with the other employees as made under Memo No. 3998-F(P2) dated July 15, 2019 upon granting an opportunity of hearing to the representative of the petitioners, and thereafter, pass necessary reasoned order within a period of six weeks from the date of communication of this order.

The reasoned order should be communicated to petitioners within a week from the date of passing such reasoned order.

With the aforesaid observation the writ petition is disposed of.

Since, no affidavit-in-opposition has been called for, the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.
