The petitioners are power of attorney holders of one Sumita Mitra who claims to be the sole legal heir of one Jitendra Mohan Neogi.
The said Sumita Mitra claims that her land standing in the name of late Jitendra Mohan Neogi was acquired in the year 1995.
A letter dated 12.08.1995 addressed by the BL & LRO. Raiganj to the petitioner's father indicates that the land in question has been acquired.
The said Sumita Mitra claims to have made repeated representation to receive compensation on account of the land in question that stood in her late father as the legal heir of Jitendra Mohan Neogi.
The respondents have not replied to the same.
In those circumstances, the said Sumita Mitra shall be entitled to make a fresh representation to the respondent no. 3/Special Land Acquisition Officer, Jalpaiguri within a period of two weeks from date with regard to their claim for compensation.
The said Sumita Mitra shall file all appropriate documents in connection with such claim including the fact that she is the sole heir of late Jitendra Mohan Neogi upon receipt of such representation. The respondent no. 3 shall also verify as to whether Jitendra Mohan Neogi and Samarendra Nath Guha Neogi are one and the same person.
The Special Land Acquisition Officer, Jalpaiguri shall give a personal hearing to the said Sumita Mitra ` and/or her legal representatives and pass a suitable order within a period of one month from
the date of receipt of such representation from the petitioner.
With the aforesaid observation, the writ petition is disposed of.
