Copy of the application stated to have served upon the State. Petitioner submits that the petitioner was released on bail and thereafter on 26th August, 2019, learned Chief Judicial Magistrate, Jalpaiguri, took cognizance upon the offence mentioned in charge sheet and fixed a date for appearance and supply of copy.

On 25th November, 2019 the petitioner along with one other accused appeared before the learned Chief Judicial Magistrate, but two other accused were absent and as such the case was adjourned. Subsequent thereafter, the COVID19 pandemic started, preventing the petitioner from coming to Court.

Having heard learned Counsel appearing on behalf of the petitioner and the State the present application, being C.R.R. 98 of 2025 is hereby disposed of by giving liberty to the petitioner to surrender before the Court below within a week from date and in the event of such surrender before the Court below within the stipulated period, the Court below will dispose of the petitioner's prayer for surrender in accordance with law.
