IN THE HIGH COURT AT CALCUTTA

CIRCUIT BENCH AT JALPAIGURI CONSTITUTIONAL WRIT JURISDICTION (APPELLATE SIDE) W.P.A 603 of 2021 (Via Video Conference) Alipurduar B.Ed. Training College -versus The State of West Bengal & Ors.

Mr. Srijib Chakraborty.

...For the Petitioner.

Mr. Bikramaditya Ghosh, Mr. Momenur Rahaman.

...For the State.

Mr. Amalesh Roy, Ms. Mousumi Bhowal.

...For the University.

The petitioner prays for grant of extension of affiliation for the Session 2020-2022 for B.Ed. Courses. In compliance of the order passed by this Court in this matter on 23rd March, 2021, an inspection was conducted by the Inspection Team and the report of such inspection has been placed before this Court. From the said report, it appears that the Inspection Team recommended that the college authorities should comply with the NCTE Norms (2014) and the Statute of the University (WBUTTEPA/67(2) in respect of Infrastructural and Institutional facilities, or else the continuation of affiliation will remain withheld.

A copy of the said report has been handed over to the learned advocate representing the petitioner. In view of the recommendation of the Inspection Team, this Court disposes of the writ petition by directing the petitioner to comply with the necessary formalities for the purpose of getting extension of the affiliation.

To avoid any difficulty of the students who are pursuing their courses in the college, the University is directed to extend the affiliation of the petitioner provisionally for a period of three months within which the petitioner shall comply with all the necessary formalities as recommended by the Inspection Team. In the event the petitioner fails to comply with the recommendation, the University shall be at liberty to proceed against the petitioner in accordance with law. The inspection report dated 4th April, 2021 filed in Court today be retained with the records.

It is needless to mention that the University shall render all necessary cooperation to the petitioner for the purpose of implementation of the order passed herein.

The writ petition stands disposed of.
