Mintu Roy Mr. Swarup Das Mr. Rathin Das ...for the petitioner This is an application wherein the petitioner has prayed for for expeditious disposal of Misc. case being no. 179 of 2023, presently pending before the learned Chief Judicial Magistrate, Cooch Behar.
Petitioner submits that she has prayed for maintenance for twin daughters who are aged about one year and seven months. Such application is pending since 2023 and the next date for adducing evidence on behalf of the opposite party is fixed on 30th April, 2025. The petitioner is suffering from financial hardship and she could not maintain the children properly for want of money. Accordingly, she prayed for a direction for early disposal of the aforesaid maintenance case.
Since the prayer made by the petitioner is innocuous and if any order is passed in terms of the prayer made in the application, opposite party will have no cause to prejudice, the service of copy of the application or notice upon the opposite party is dispensed with.
Having considered the submissions made on behalf of the petitioner, which appears to be justified, the present application being CRR 105 of 2025 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the said maintenance case being Misc. case no. 179 of 2023 and to conclude the entire proceeding preferably within a period of three months from the next date of hearing,i.e. on 30th April, 2025, without granting any unnecessary adjournment to either of the parties and if possible by making day to day hearing. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
