Gau Gyan Foundation v. The State Of West Bengal And ORS
22-08-2023 Court No.3 bm/mg/4.
In The High Court At Calcutta Jalpaiguri Circuit Bench C.R.R. 48 of 2020 GAU GYAN FOUNDATION Vs.
The State of West Bengal & Ors.
Mr. Vinay Shraff Ms. Priya Saraf Paul Mr. Sandip Guha Roy ... for the petitioner.
Mr. Nilay Chakraborty ... for the State Heard learned Counsel for the petitioner as well as Mr. Chakraborty, learned Senior Government Pleader.
It is stated by the learned Counsel for the petitioner that the learned Trial Court did not consider the points of law raised by the learned Counsel.
On perusal of the impugned Order, it appears that the learned Trial Court should consider the matter applying the statutory provisions, which is missing. Therefore, the matter is sent back to the learned Trial Court. Learned Trial Court shall consider points
raised and shall pass reasoned Order independently.
Accordingly, the instant revisional application is disposed of along with pending application, if any.
