The husband of petitioner died on 19.2.2018 and PPO was issued on 25.1.2019. In the meantime ROPA rule was introduced with effect from 1st January, 2019 and subsequently the gratuity as well as the pension of the petitioner was revised on 24.3.21 and the same was paid to the petitioner on 26.3.2021. Now the petitioner claims interest on the gratuity amount as well as on arrears of pension from 19.2.2018 till 26.3.2021.

Considered the submission made by the petitioner, this Court finds that there is a delay of three years in releasing gratuity

and pension of the petitioner. The petitioner is entitled to get interest on gratuity amount as well as on arrears of pension at the rate of 08 per cent per annum with effect from 19.2.2018 till 31.3.2021. The respondents are directed to release the interest on gratuity as well as on arrears of pension at the rate of 08% per annum in favour of the petitioner within a period of four weeks from the date of communication of this order.

WPA 438 of 2023 is thus disposed of.
