Heard the learned Advocates appearing for the parties. It is submitted on behalf of the petitioner that she had an illicit relationship with the victim who subsequently committed suicide.

Learned Advocate appearing for the State opposes the prayer for bail.

We have considered the materials on record. It is a matter to be decided at the appropriate stage of the proceeding whether the conduct of the petitioner would

constitute abetment to suicide or not. No suicide note was left behind by the victim implicating the petitioner. In view of the aforesaid facts, we are inclined in granting anticipatory bail to the petitioner. Accordingly, we direct that in the event of arrest the petitioner viz., Sanjita Chettri alias Sangita Chettri shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on condition that the petitioner shall appear before the trial court and pray for regular bail within four weeks from date.

This application for anticipatory bail is, thus, disposed of.
