The husband of the petitioner died on 3.10.2016 and PPO was issued on 15.2.2018. In the meantime ROPA rule was introduced with effect from 1st January, 2019 and subsequently the gratuity as well as the pension of the petitioner was revised on 17.12.2020 and the same was paid to the petitioner on 31.12.2020. Now the petitioner claims interest on the gratuity amount as well as on arrears of pension from 30.10.2016 till 31.12.2020.

Considered the submission made by the petitioner, this Court finds that there is a delay of four years in releasing gratuity

and pension of the petitioner. The petitioner is entitled to get interest on gratuity amount as well as on arrears of pension at the rate of 10 per cent per annum with effect from 03.10.2016 till 31.12.2020. The respondents are directed to release the interest on gratuity as well as on arrears of pension at the rate of 10% per annum in favour of the petitioner within a period of four weeks from the date of communication of this order.

WPA 439 of 2023 is thus disposed of.
