The petitioner has superannuated from his service on 29.2.2016 and PPO was issued on 24.5.2016. In the meantime ROPA rule was introduced with effect from 1st January, and subsequently on 23.9.2021 the gratuity as well as the pension of the petitioner was revised and the same was paid to the petitioner on 27.9.2021. Now the petitioner claims interest on the gratuity amount as well as on arrears of pension from 29.2.2016 till 27.9.2021.
Considered the submission made by the petitioner, this Court finds that there is
a delay of five years for release of arrears of gratuity and pension of the petitioner. The petitioner is entitled to get interest on gratuity amount as well as on arrears of pension at the rate of 10 per cent per annum with effect from 29.2.2016 till 27.9.2021.
The respondents are directed to release the interest on gratuity as well as on arrears of pension at the rate of 10% per annum in favour of the petitioner within a period of four weeks from the date of communication of this order.
WPA 440/2023 is thus disposed of.
