Banerjee) Ms. Sayantani Das ... for the petitioner Ms. Bedashruti Bose Mr. Sandip Guha Roy ... for the State In this application under Article 226 of the Constitution of India the petitioner has prayed for a direction upon the Superintendent of Police, Jalpaiguri and the Inspector of Kotwali Police Station to take steps pursuant to the complaint lodged by the petitioner vide letter dated January 3, 2025.

After going through the said complaint this Court finds that the petitioner has alleged that the private respondents herein have forcibly occupied the property of the petitioner and have constructed a room thereupon. Such an issue is purely a private dispute for which this Court is not inclined to grant any relief in favour of the petitioner.

In view thereof, WPA 481 of 2025 is disposed of by directing the Inspector in Charge, Kotwali Police Station to see that no breach of peace takes place at the locale.

Learned advocate for the State submits that the police authorities have enquired into the matter and a prosecution under Section 126 BNSS has been submitted.

Such submission of the learned advocate for the State is placed on record.
