The petitioner is alleging that his land has been acquisitioned in Requisition Case No.22/76-77 but compensation has not yet been paid.
This Court by the order dated March 5, 2024 directed the State to file a report.
Mr.
Momenur Rahman, learned Advocate for the State submits that instead of filing a report, it would be convenient if the petitioner is directed to file a comprehensive representation and with a further direction upon the Special Land Acquisition Collector, Cooch Behar, the respondent no.6, the respondent no.6 herein to consider and dispose of such representation.
On such suggestion of Mr. Rahman, this Court directs the petitioner to submit a comprehensive representation before the respondent no.6 with relevant documents in support of his allegation and the said respondent shall consider and dispose it of in accordance with law after giving all concerned an opportunity of hearing by the end of the month of June, 2024 from the date of submission of such representation.
WPA 437 of 2024 is disposed of with the above terms without any order as to costs.
Since no affidavit has been invited, the allegations made in the writ petition are deemed to have been denied by the respondents.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
