TN Calcutta High Court In The Circuit Bench at Jalpaiguri Criminal Miscellaneous Jurisdiction CRM 279 of 2021 In Re : An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, filed on 25.02.2021 in connection with Matigara Police Station Case No.935 of 2020 dated 01.09.2020 under Sections 498A/304B/34 of the Indian Penal Code, 1860, read with Sections 3/4 of the Dowry Prohibition Act.

Learned counsel for the petitioners submits that the petitioner no.1 is the father-in-law and the petitioner no.2 is the mother-in-law of the victim.

The petitioners submit that they reside at a distant place, separately, from the husband of the victim.

Learned counsel for the State produces the case diary and opposes the prayer for anticipatory bail.

Having regard to the materials on record, prima facie we do not find anything against the petitioners justifying their custodial interrogation.

In view of the matter, the prayer for anticipatory bail is allowed. In the event of arrest the petitioners will be released on

bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer, subject to further conditions that the petitioners will meet the Investigating Officer as and when called for and they will otherwise co-operate with the investigation. The petitioners are also directed to comply with the conditions under Section 438(2) of the Code of Criminal Procedure. (Sabyasachi Bhattacharyya, J.) (Kausik Chanda, J.)
