19.08.19 Sl. No.166 Ct. No.1 akd [Rejected] CALCUTTA HIGH COURT In the Circuit Bench at Jalpaiguri C. R. M. 621 of 2019 In Re: An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 24.07.2019 in connection with Haldibari Police Station Case No. 116 of 2019 dated 19.06.2019 under Sections 341/325/326/506/34 of the Indian Penal Code. (G.R. Case No.300 of 2019) And In Re: Latif Houque Sarkar & Ors.
... ... Petitioners Mr. Hillol Saha Podder .. Advocate ... ... for the petitioners Mr. Ujjwal Luksom .. Advocate Mr. Biswarup Roy .. Advocate ... ... for the State Heard the learned advocate appearing for both the parties. Having considered the materials on record disclosing prima facie involvement of the petitioners in causing grievous stab injury on the victim, we are of the opinion that the petitioners do not stand on the same footing as the co-accused persons who have been granted prearrest bail. Hence, we are not inclined in granting anticipatory bail to the petitioners.
Accordingly, the prayer for anticipatory bail of the petitioners stands rejected.
