Case No.359 of 2023 dated 03.05.2023 under Sections 21 (C)/22(C)/25/29 of the Narcotics Drugs and Psychotropic Substances Act, 1985 pending before the learned Judge, Special Court (under NDPS Act), 1st Court at Jalpaiguri.

It is not in dispute that a similarly circumstanced accused, Suresh had been granted bail by this Court on November 11, 2024, on the ground of delay in conducting the trial.
The Suresh was in custody for about 820 days. The petitioner claims bail on the ground of parity, Learned advocate representing the State does not dispute the fact that it is the same seizure list that connects the petitioner and Suresh.
It is, however, submitted by the State that the trial has already been commenced by way of framing charge on March 28, 2025.
It is not in dispute that out of 18 (eighteen) prosecution witnesses, no one has been examined so far. The trial is not expected to be concluded within a reasonable period of time. In that view of the matter, the present application for bail is allowed.
Accordingly, it is directed that the petitioner namely Pramir Lama @ Leeching shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of like amount one of whom must be local, to the satisfaction of the learned Judge, Special Court under NDPS Act, Jalpaiguri subject to condition that he shall appear before the trial court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.
In the event the petitioner fails to appear before the Trial Court without any justifiable cause, the trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
Accordingly, CRM (NDPS) 77 of 2025 is, thus, disposed of.
Let an urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on the usual undertakings.
