1. Petitioners renew the prayer for bail on the ground of delay in disposal of the appeal.

2. Petitioners are in custody for a period slightly in excess of one year four months. Trial is in progress. Out of 16 prosecution witnesses, one prosecution witness was partly examined.

3. Learned advocate appearing for the petitioners submits that, co-accused were granted bail by the jurisdictional Court.

4. It appears from the materials in the case diary that, there is at least one eyewitness who saw the petitioners to be involved in the murder of the victim.

5. Post Mortem Report classifies the death is due to the injuries noted in such report ante-mortem and homicidal in nature.

6. There are at least 9 wounds found on the body of the victim as appearing from the Post Mortem Report. Injuries noted, were by sharp cutting weapon. Murder appears to be brutal.

7. Considering the gravity of the offence and involvement of the petitioners therein, I am not minded to grant bail to the petitioners.

8. Moreover, in the event, the petitioners are enlarged on bail at this stage, there is every chance of trial being prejudiced.

9. Prayer for bail of the petitioners stands rejected.

10. CRM (M) 73 of 2026 is dismissed.
