The petitioner has superannuated from his service on 28.2.2017. In the meantime ROPA rule was introduced with effect from 1st January, and subsequently on 4.1.2021 revised PPO was issued. The gratuity as well as the pension of the petitioner was revised and the same was paid to the petitioner on 22.1.2021. Now the petitioner claims interest on the gratuity amount as well as on arrears of pension from 28.2.2017 from 22.1.2021.

Considered the submission made by the petitioner, this Court finds that there is a delay of four years for release of arrears of

gratuity and pension of the petitioner. The petitioner is entitled to get interest on gratuity amount as well as on arrears of pension at the rate of 10 per cent per annum with effect from 28.2.2017 from 21.2.2021.

The respondents are directed to release the interest on gratuity as well as on arrears of pension at the rate of 10% per annum in favour of the petitioner within a period of four weeks from the date of communication of this order.

WPA 473 of 2023 is thus disposed of.
