Circuit Bench of Calcutta High Court at Jalpaiguri sm 28.08.

W.P.A. 275 of 2019 Abhijit Biswas

Versus

The State of West Bengal & Others Mr. Nabankur Paul.

.....for the petitioner.

Ms. Bedashruti Bose.

Mr. Bikramaditya Ghosh.

.....for the State.

Affidavit of service filed in court today be kept with the record.

Both sides are represented. The grievance of the writ petitioner is that, despite having been transferred to the Election Section as a part-time multi tasking worker as per order dated July 24, 2017, as appearing from annexure P-10 at page 36 of the instant writ petition, the remuneration of the petitioner is not being disbursed since such transfer. The petitioner complains that several representations were made by the petitioner to that effect, but all in vain. It is unfortunate that the petitioner has been deprived of his legitimate dues despite having joined as long back as on July 24, 2017, causing considerable hardship to the petitioner.

Accordingly, W.P.A.275 of 2019 is allowed, thereby directing the respondent no.5 to immediately assess the arrears of wages payable to the petitioner

and to disburse such arrears and to continue disbursing the regular remuneration to the petitioner within due time. Such arrears shall be assessed and disbursed to the petitioner within a month from date. The respondent no.5 shall go on paying the current remuneration to the petitioner with immediate effect. There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, shall be given to the parties upon compliance of usual formalities.
