in a suit for confirmation of possession and perpetual injunction being Title Suit No. 68 of 2013 pending before the Court of learned Civil Judge (Junior Division) at Jalpaiguri, District : Jalpaiguri is the petitioner of the present application under Article 227 of the Constitution of India.

The petitioner is complaining of the delay in recording the evidence of P.W.1, which was started on July 30, 2019.

Mr. Ghosh, learned counsel, appearing on behalf of the plaintiff/opposite parties submits that his clients are not responsible for the said delay as it has been occasioned due to intervention of Covid-19 pandemic.

Be that as it may, the suit is pending since 2013 and the trial of the suit since has already been commenced, the learned Trial Judge is

requested to dispose of the said suit as expeditiously as possible in accordance with law, preferably within six available effective working months of his Court from the date of communication of this order and in doing so shall not entertain the prayer of the parties for any unnecessary adjournment.

CO 24 of 2022 is disposed of on the above terms without any order as to costs.
