The writ petitioner is aggrieved by the fact that his representation dated 14th January 2022 in response to an E-Tender for supply of 2 wire 12 Way ETMF Telecom to the North Frontier Railway, Alipurduwar Division has not been considered.

Counsel for the Union of India, Mr. Mazumdar, submits that the awardee of the tender, namely M/s. Ishan Trade Communication, Alipurduwar Jalpaiguri is a necessary party.

In that view of the matter, the respondent No.5 shall consider the writ petitioner's representation and dispose of it in accordance with law within a period of one month from date.

For the aforesaid purpose, the writ petitioner shall be entitled to make a representation afresh to the respondent No.5 within a period of three days from date. It is made absolutely clear that this Court has not, in anyway interfered with the award of the tender to M/s.

Ishan Trade Communication, Alipurduwar, Jalpaiguri.

The petitioner shall serve notice of this order along with a copy of the writ petition to the M/s. Ishan Trade Communication, Alipurduwar Jalpaiguri.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
