PP Mr. Sudip Ghosh Mr. Bitasok Banerjee ..for the State This is an application seeking an expeditious disposal of a proceeding in which a charge-sheet was submitted under Sections 406 and 420 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner lodged a First Information Report on 15.11.2018. A charge-sheet was submitted on 25.02.2019. Till date even charges have not been framed. The proceeding has remained pending for no fault of the present petitioner. Learned Public Prosecutor representing the State submits that no inordinate delay has been occasioned in this case. However, the State would not come in the way if a direction is passed to expedite the proceeding. I have heard the submissions of the learned counsels appearing on behalf of the petitioner and the State and have perused the revision petition.
No prejudice will be caused to anyone if a direction is passed in respect of the prayer for expeditious hearing.
Here, a First Information Report was lodged in 2018 and a charge-sheet was submitted in February, 2019. It is quite strange that despite these, even charges could not be framed till date.
In view of the same and in the interest of justice, I request the learned trial Court to conclude the proceeding as expeditiously without granting any unnecessary adjournment to any of the parties and in particular, to decide the question of framing of charges at the earliest.
With these observations, the revisional application is disposed of.
