Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the mother of the victim deceased. In 2021, the body of the victim was found with his head smashed. The petitioner filed an FIR and Dinhata PS Case No. 169 dated 11.04.2021 was started under Sections 302 and 34 of the Indian Penal Code. In spite of this, till date no proper investigation has been done in this case. Neither has any accused being arrested nor has any charge sheet been submitted.

Learned counsel appearing on behalf of the State relies on the report, which is taken on record and fairly

submit that much is required to be done in respect of the investigation into the present case.

It appears that during investigation, a few statements were recorded and finger prints were collected. But, no real effort was done to unearth truth.

In view of the same, let the Superintendent of Police, Cooch Behar constitute a Special Investigating Team to investigating to the alleged offence. The said team be headed by the SDPO, Dinhata, Cooch Behar. Let the team be formed within seven days from this date. Let them take over the investigation of the present case and conclude the same in accordance with law and as expeditiously as possible.

With these observations, the writ petition is disposed of.
