The grievance of the writ petitioner is that he appealed to his authority submitting a representation dated 29th October, 2018, seeking enhancement of his wages/salary/remuneration in terms of a Memorandum No. 1107-F(P), dated 25th February, 2016, and letter dated 1st August, 2016, issued by the Finance Department, as well as Deputy Secretary of the Government of West Bengal, but till date the said representation has not been duly considered resulting in extreme financial hardship to the writ petitioner, who has been serving as a part-time sweeper on consolidated pay after being employed in the office of Director of Micro and Small Scale Enterprises i.e. at the District Industries Centre, Cooch Behar.

representing the State respondents proposes for exchange of affidavits in this case to address the point involved in this writ application.

The grievance raised in this writ application together with relief sought for being simple and innocuous, the Court is of the view that exchange of affidavits is unnecessary in this case. If any direction for affidavit is given that may cause delay in the litigation. Having considered the submission of the learned advocate for the petitioner and bearing in mind the materials placed in the writ application, in particular the representation submitted by the writ petitioner, dated 29th October, 2018, let there be a direction upon the Respondent No. 2, being the Director, Micro, Small and Medium Enterprises, to consider the last representation submitted by the petitioner dated 29th October, 2018, in terms of the Government Circular, Memorandum, if any, issued for the purpose, as mentioned over there and dispose of the same recording a reasoned order, and if necessary extending hearing to the writ petitioner upon issuing notice for the purpose. Such exercise may be completed within two months from the date of communication of this order.

With this direction and observation, the writ application stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all the formalities.
