The writ petitioner claims that the State has constructed pillars over his land which comprises about 5.03 acres.

The said land is stated to be adjacent to and adjoining a Krisak Bazar MouzaBirpara at Alipurduar. Counsel for the State submits that in the first place no construction has been effected by the State on any land in the said particular area. It is also submitted by the State counsel that the entirety of 5.03 acres of land as claimed by the writ petitioner does not in fact stand in his name.

Since there is no construction as submitted by the counsel for the State,

no interference is called for in the writ petition.

With the aforesaid observations, the writ petition is disposed of.

The writ petitioner may take steps in accordance with law as he may be advised.

There will be no order as to costs.
