Mr. Sunit Kumar Roy ...for the SSC Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an Assistant Teacher of Bhotebari Sitanath High School, Cooch Behar. He made an application for transfer on the ground of distance through the online portal in 2021. It appears that there was some technical problem in processing the same. However, thereafter the Utsashree Portal was suspended. The petitioner wants to file a fresh application praying for transfer.

Learned counsel appearing on behalf of the School Service Commission submits that if any application is made, the same has to be on in an offline mode and in the format as per the Rules of 2015.

In view of the above, the petitioner is granted liberty to file an application seeking transfer on the ground of distance before the concerned authorities in the offline

mode and in the prescribed format as per the Rules of 2015. The School authorities shall forward the same to the DI who, in turn, shall forward the papers to the School Service Commission for appropriate action.

In the event the application is made within two weeks from this date, the concerned authorities shall consider the prayer in accordance with law and as expeditiously as possible, preferably within a period of ten weeks from the date of communication of this order. With these observations, the writ petition is disposed of.

As affidavits were not called for, allegations contained in the writ petition are deemed not to have been admitted.

Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
