06.08.2019 tkm/ct 28 C.R.M. 6982 of 2019 sl no. 162 In Re : An application for bail under section 439 of the Code of Criminal Procedure filed on 1.8.2019 in connection with Mathabhanga P.S. Case No. 284 of 2018 dated 18.9.2018 under section 20(b)(ii)(c) of the NDPS Act and adding section 29 of the NDPS Act And In Re : Gokul Sarkar ........ petitioner Md. Kutubuddin ...... for the petitioner Mr. S. Bardhan Ms. Ayantika Roy ...... for the State Heard the learned advocates appearing for the parties.

Having considered the materials in the case diary disclosing prima facie involvement of the petitioner in dealing in narcotic substance above commercial quantity and in view of the fact the call detail records show continuous communication between the petitioner and the principal accused persons at the time of transportation of narcotic substance, we are of the opinion that this is not a fit case to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, trial court is directed to expedite the trial and conclude the same as expeditiously as possible without granting adjournment to either of the parties.
