1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. In the writ petition order of termination issued by the Medical Superintendent-cum-Vice Principal MJN Medical College and Hospital, Cooch Behar is under challenge. Petitioner was holding the post of General Duty Attendant (GDA) of MJN Medical College and Hospital, Coochbehar which is a Government Medical College.

3. State respondents are represented by Mr. Joyjit Chowdhury, learned Additional Advocate General who has taken the point of maintainability of this writ petition since petitioner was holding a civil post.

4. As it is found from records that petitioner was holding a post in a Government Medical College this writ petition is not maintainable.

5. Hence, writ petition stands dismissed.

6. However, this order shall not preclude the petitioner to approach West Bengal State Administrative Tribunal by filing an original application on the self same issue.

7. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertaking. (Saugata Bhattacharyya, J.)
