For the State Having regard to the fact that the alleged incident took place after 25 years of marriage and considering the materials on record, we are of the opinion that the petitioner should be given benefit of anticipatory bail. The prayer for anticipatory bail is allowed subject to the conditions that in the event of arrest the petitioner will be released on bail subject to furnishing bond of Rs.10,000/- with two sureties of like amount each to the satisfaction of the arresting officer. Petitioner will comply with the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.

The application for anticipatory bail, being CRM 318 of 2021, is allowed.
