The petitioner has filed an affidavit affirmed today stating that the petitioner has received a payment of Rs. 7, 46, 189/- on 15th July, 2020 and also received the earnest money of Rs.7,000/- on 3rd December, 2020 through NEFT.

The Bank statements have been annexed to the affidavit. Counsel submits that by reason of the payment received the petitioner, like to withdraw the writ petition.

Counsel for the State is present. It may be mentioned that prayer (a) of the writ petition was for a direction on the District Magistrate, Jalpaiguri to refund the earnest money of Rs.7,000/- along with build amount of Rs.7,72,368/-.

By reason of the affidavit and the submissions made on behalf of the petitioner, WPA 683 of 2020 is dismissed as withdrawn.
