Affidavit of service filed in Court today is taken on record.

The petitioner has preferred the present writ petition alleging inaction on the part of the respondents in not considering the petitioner's application dated 18.02.2026 for transfer from Swamiji Prathamik Vidayalaya School to any other school nearby school to the petitioner's residence within Bishnupur Circle.

Learned Counsel appearing for the petitioner submits that the petitioner has been working as an Assistant Teacher with the said school since 23.07.2021. The petitioner submits that her residence is approximately kilometers away from the place of work. She

further submits that she has four year old child. She is suffering from various Gynecological issues. Hence, it is difficult for her to commute between her residence and the school. It is submitted that the petitioner had earlier made representations dated 13.05.2025 and 03.07.2025 seeking transfer to a school nearer to her place of residence. Pursuant thereto, the respondent authority conducted a medical examination and a report in this regard was forwarded to the West Bengal Board of Primary Education. However, no decision has been taken on the said representation.

Considering the submissions of the learned Counsel for the petitioner and perusing the materials on record, this Court directs the respondent No.3 to decide the petitioner's representation dated 18.02.2026 within a period of eight weeks from the date of communication of this order in accordance with law and the relevant rules by way of a speaking order.

It is made clear that this Court has not expressed any opinion on the merits of the petitioner's claim and all issues are left open to the competent authority to decide the same in accordance with law. If the application of the

petitioner for transfer is allowed the necessary consequential steps shall be taken in accordance with law without further delay.

With the aforesaid directions, the present writ petition stands disposed of.

Since no affidavits have been called for, all allegations made in the writ petition shall be deemed to have been denied.
