Mr. Avijit Ghosh Ms. Angana Rakshit ...for the petitioner This is an application wherein the petitioner has prayed for expeditious disposal of Sessions case being no. 169 of 2023, presently pending before the learned Additional Sessions Judge, Mathabhanga.
It is submitted that in a proceeding initiated under Section 417/420/376 of the Indian Penal Code, the police has submitted charge-sheet on 30th March, 2023. Since then, the said proceeding is pending for disposal.
On earlier occasion, the petitioner also prayed for early disposal of the said case and this High Court while disposing CRR 159 of 2024 dated 16.5.2024, was pleased to direct the Trial court to dispose of the Sessions case being no. 169 of 2023 arising out of aforesaid G.R. case no. 580 of 2022 preferably within a period of six months from the date of communication of the order. In spite of that, it reflects from the last order dated 10th February, 2025 that the Trial court has examined six witnesses
only but as per the charge-sheet, there are fifteen witnesses, which the prosecution is intended to examine. In such circumstances, a further direction may be passed upon the court below for expeditious disposal of the said sessions case.
Since the prayer made by the petitioner is innocuous and if any order is passed in terms of the prayer made in the application, neither party will have a cause to prejudice, the service of copy of the application or notice upon the State or upon the private opposite party is dispensed with. Having considered the submissions made on behalf of the petitioner and that in spite of the previous direction made by this court, the matter is dragging for a considerable period of time, the Trial court is directed to make every endeavour for expeditious disposal of the sessions case being Sessions case no. 169 of 2023, presently pending before the learned Additional Sessions Judge, Mathabhanga and to make his best effort to conclude the entire proceeding preferably within a period of three months from the next date of hearing, i.e. on 10th June, 2025, without granting any unnecessary adjournment to either of the parties and if possible by making day to day hearing.
CRR 121 of 2025 is accordingly disposed of.
