Mr. Avijit Ghosh Ms. Angana Rakshit ...for the petitioner This is an application wherein the petitioner has prayed for expeditious disposal of POCSO case no. 3 of 2023, presently pending before the learned Special Judge under POCSO Act, Mathabhanga, Cooch Behar.

It is submitted that in a proceeding under the POCSO Act read with other provisions of the Indian Penal Code, the police submitted charg-sheet against the opposite party nos. 2 to 4 on 4.4.2023. Since then, the matter is pending and the next date is fixed on 23rd April, 2025 for appearance and for charge hearing. Learned counsel for the petitioner submits that a direction may be passed upon the court below for expeditious disposal of the said POCSO case.

Since the prayer made by the petitioner is innocuous and if any order is passed in terms of the prayer made in the application, the opposite party will have no cause to prejudice, the service of copy of the application or notice upon the the opposite parties is dispensed with.

Having considered the submissions made on behalf of the petitioner, I find the prayer made by the petitioner is justified and required to be allowed for the ends of justice. In such view of the matter, CRR 122 of 2025 is accordingly disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the case and to make his best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing, i.e. on 23rd April, 2025, without granting any unnecessary adjournment to either of the parties and if possible by making day to day hearing. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
