The primary grievance of the writ petitioner is that while he has been allowed pension after condonation of delay of 14 days, yet his pension payment order contained an endorsement that he was not entitled to family pension.

The learned advocate for the State fairly submits in Court that the endorsement is incorrect that the petitioner is in fact entitled to family pension.

In those circumstances, the endorsement in the pension payment order of the petitioner dated 29.10.2018 shall stand rectified to delete the expression "no family pension".

The petitioner shall be entitled to family pension along with pensionary benefits.

The petitioner shall be immediately allowed his monthly pension along with arrears preferably within a period of three weeks from the date of communication of a copy of this order.

With the aforesaid directions, the writ petition is disposed of.
