16.03.2021 BPG Calcutta High Court In The Circuit Bench at Jalpaiguri Criminal Miscellaneous Jurisdiction CRM 336 of 2021 (Via Video Conference) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 in connection with Falakata Police Station Case No.06 of 2021 dated 09.01.2021 under Sections 498A/304B of the Indian Penal Code, 1860 read with 3/4 of the Dowry Prohibition Act, 1961.
And In the matter of: Smt. Tuli Sarkar and others .... Petitioners Mr. Arnab Saha ... For the Petitioners Mr. Ujjwal Luksom, Ms. Namrata Das.
... For the State Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case and there is no material on record to substantiate the fact that they have any role in the instant case.
Learned counsel for the State opposes the prayer for anticipatory bail.
Having regard to the materials on record and the statements recorded under Section 161 of the Criminal Procedure Code, we do not think that the petitioners should be granted the benefit of anticipatory bail particularly when the investigation is in progress. The prayer for anticipatory bail is rejected. CRM 336 of 2021 is thus disposed of.
