18.08.2020 Sl. No.62 akd [Rejected] C. R. M. 5579 of 2020 [via video conferencing] (CRAN 3936 of 2020) In Re: An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 04.08.2020 in connection with Banarhat Police Station Case No. 45 of 2020 dated 24.02.2020 under Sections 498A/376(2)(g)/302/120B of the Indian Penal Code.

And In Re: Rebati Mohan Das & Ors.

... ... Petitioners Mr. Sudip Guha .. Advocate ... ... for the petitioners Mr. Nilay Chakraborty .. Advocate Mr. Tapan Bhattacharyya .. Advocate ... ... for the State Petitioners undertake to affirm and stamp the petition/application as per Rules within a month of resumption of normal functioning of the court. Subject to such undertaking, the application is taken up for hearing through video conferencing. The application being CRAN 3936 of 2020 is accordingly, disposed of. Having considered the materials on record disclosing prima facie involvement of the petitioners in subjecting the victim-housewife to torture and murdering her, we are of the opinion that in view of the gravity of the offence this is not a fit case to grant anticipatory bail to them.

Accordingly, the prayer for anticipatory bail of the petitioners stands rejected. (Kausik Chanda, J.) (Joymalya Bagchi, J.)
