The petitioner has preferred the present writ petition, seeking a direction upon respondent authorities to release the of payment of Rs.53,15,220/- along with interest at 8% per annum, for carrying out temporary electronic installation at different schools under Banarhat PS, Dhupguri PS, Haldibari PS, Kotwali PS, Mal PS, Mayanaguri PS, Mettali PS, Nagrakata PS and Raiganj PS for accommodation of CAPF, SPF and security lights with logistic support for ensuing Assembly Election in West Bengal, 2021.

It is the case of the petitioner that the respondent nos. 6, 7 and 8, issued Notices

Inviting Tenders for all the districts of West Bengal. The petitioner participated in the tender for the District of Jalpaiguri and was found to be the lowest bidder, awarded with the tender and work order. Thereafter, the petitioner completed the work within the stipulated period of time to the complete satisfaction of the concerned respondent authorities. Consequently, on being satisfied, the respondent authorities issued completion certificates for the work completed by the petitioner. It is the further contention of the petitioner that out of total admitted amount payable to the petitioner, only a partial payment has received but the entire amount has not been given to him.

Learned Counsel for the petitioner states that the petitioner has made several representations for payment of unpaid admitted dues but he has not heard anything from the concerned department.

Learned Counsel for the State-respondent appears and submits that the authority is ready and willing to consider the petitioner's representation dated 03.03.2025.

Learned Counsel for the petitioner states that his client shall be satisfied if his

representation dated 03.03.2025 is decided within a time bound manner.

In view of the statement made by the learned Counsel for parties, this Court direct the respondent No.6 to decide the petitioner's representation dated 03.03.2025 within a period of six weeks from date of communication of this order after granting an opportunity of personal hearing to the petitioner by way of a speaking order.

With the above direction, the present writ petition is disposed of.

Since no affidavit is called for, allegations made in the petition are deemed to have been denied.

There shall be no order as to costs.

Photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on usual undertaking (Gaurang Kanth, J.)
