W.P. 15598 (W) of 2019 Shri Bishnu Barma & Ors.

Vs.

The State of West Bengal & Ors.

Mr. P. Chakraborty Mr. Arkadipta Sengupta ...For the petitioners.

Mr. Avra Mazumder ..For the State.

The petitioners enjoyed temporary liquor license. The same was suspended by a writing dated March 2, 2019 on the ground of then impending General Elections of 2019.

Learned advocate for the petitioners submits that, since the General Elections of 2019 are now over, the authority should resume the existing licenses.

State is represented.

In the facts of the present case, the temporary licenses in favour of the petitioners stood suspended due to the writing dated March 2, 2019. The writing dated March 2, 2019 is founded upon the General Elections of 2019. The General Elections of 2019 are now over.

In such circumstances, it would be appropriate to direct the Excise Commissioner to reconsider their decision dated March 2, 2019 since the General Elections of 2019 are over. The Excise Commissioner will inform his decision to the petitioners within a period of fortnight from the date of communication of this order. W.P. 15598 (W) of 2019 is disposed of without any order as to costs.

Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance of the requisite formalities.
