Circuit Bench at Jalpaiguri C.R.M.(NDPS) No. 138 of 2024 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with NJP Police Station Case No. 744 of 2023 dated 01.08.2023 under Sections 21(c )/22(c )/25/29 of the NDPS Act.

And In Re : Mukit Alam @ Md. Mukit Alam .... petitioner Mr. Debajit Kundu ....for the petitioner Mr. Abhijit Sarkar Mr. Saikat Chatterjee .... for the State 1.

Heard the learned Counsels for the parties.

We have considered the materials on record.

Statements of witnesses and seizure memorandum show recovery of 622 gms. of Brown Sugar i.e. Heroin above commercial quantity was recovered from the petitioner. In view of the aforesaid circumstances and statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

3. Application for bail is, thus, rejected.
