The petitioner alleges that the Public Health Engineering Directorate is utilizing the private land of the petitioner without acquiring the same in accordance with law.

A representation has been filed before the District Magistrate and also before the Public Health Engineering Directorate. The same is yet to be considered.

Learned advocate representing the State respondents is yet to receive instruction.

As it appears that the representation of the petitioner is pending consideration at the end of the Directorate, the alleged requiring body, accordingly, no useful purpose will be served by keeping the writ petition pending.

The writ petition is, accordingly, disposed of by directing the Executive Engineer, Public Health Engineering Directorate, Cooch Behar being the respondent no. 3 herein to consider and dispose of the representation filed by the petitioner in accordance with law at the earliest but positively within a period of eight weeks from the date of communication of this order.

An opportunity of hearing be provided to the petitioner and all other necessary parties prior to final disposal of the representation.

Learned advocate for the petitioner is directed to forward a copy of the representation seeking consideration to the aforesaid respondent at the time of communicating the order of the Court. 8.
If the allegation of the petitioner is found to be proper, then necessary remedial steps shall be taken in accordance with law.

The writ petition stands disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
