07.08.2020 SL No.42 AP CRM 5320 of 2020 (Through Video Conference) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Jalpaiguri Kotwali P.S. Case No.390/2020 dated 20.06.2020 under Sections 302/34 of the Indian Penal Code.

And In the matter of: Jhantu Das & Anr.

....Petitioners.

Mr. Debajit Kundu ...for the Petitioners.

Mr. Saibal Bapuli, Ld. A.P.P.

...for the State.

Petitioners undertake to affirm and stamp the petition/application as per Rules within one month of resumption of normal functioning of the Court. Subject to such undertaking, the application is taken up for hearing through video conference. Having considered the materials on record disclosing prima facie involvement of the petitioners in the murder of the victim and as custodial interrogation of the petitioners are necessary for the progress of the investigation, we are not inclined to grant anticipatory bail to the petitioners.

The application for anticipatory bail is, thus, rejected. The parties shall act in terms of the copy of the order downloaded from the official website of this court. (Abhijit Gangopadhyay, J.) (Joymalya Bagchi, J.)
