Mr. Arnab Sengupta Mr. Debarshi Dhar ......for the petitioner Mr. Subir Kumar Saha Mr. Momenur Rahman ......for the alleged contemnor Learned counsel for the petitioner has filed the present contempt petition alleging willful disobedience of the order dated 18.09.2023 passed by this Court in Writ Petition No. 539 of 2023.

At the outset itself, learned counsel for the respondent has appeared on advance notice and states that they are willing to pass a fresh order by recalling the earlier order dated 30.01.2023 and will comply with the earlier directions passed by this Court, especially in terms of Para19 of the order dated 22nd December, 2015 in Writ Petition No. 27394 of 2015.

In view of the same, the petitioner does not wish to press the present contempt petition but seeks liberty to approach this Court if the respondent fails to abide by the

submission made before this Court within a period of three weeks from today.

In view of the above, the contempt petition is withdrawn by the petitioner and the same is dismissed as withdrawn.
