Petitioner is aggrieved by the order dated 18.01.2025 rejecting the prayer of the petitioner for release of the seized fire-crackers.

Learned advocate appearing for the State opposes the prayer of the petitioner.

Records reflect that the police authorities, on inspection, found 113 packets of Chocolate Bomb and there was misdeclaration of the fire-crackers which were transported.

Petitioner contends that he has licence for carrying out the business.

In view of the contentions advanced on behalf of the petitioner, I direct that if the petitioner is able to show that he has been granted licence for manufacturing fire-crackers wherein permission has been granted in respect of such materials which emits sound 90 decibel at distance of 4 metres, in that case, learned Magistrate, by adhering to the provisions of law, would pass necessary orders. With the aforesaid observations, the revisional application being CRR 129 of 2025 is disposed of.

Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
