Mr. Rounak Ghosh, learned Advocate appearing for the petitioner, submits that the petitioner is a neighbour of the accused persons and had allegedly acted as a matchmaker in the negotiation of the marriage solemnized between the victim and the accused person no.
1. He further submits that the charge-sheet has been submitted and all the accused persons are on bail. Therefore, according to him, custodial interrogation of the petitioner is not required. Mr. Chinmoy Roy, learned Advocate appearing on behalf of the State, produces the case diary and opposes the prayer for anticipatory bail on the basis of the materials available therein. He submits that there
are specific allegations against the present accused person, as reflected in the case diary.
Heard the learned advocates appearing for the respective parties and perused the materials on record, including the case diary. The present case was initiated under Sections 498A/302/34 of the Indian Penal Code. After completion of the investigation, a chargesheet has been submitted under Sections 498A/306/34 of the Indian Penal Code. The other accused persons are also on bail. I am, therefore, of the view that custodial interrogation of the present petitioner will not serve any useful purpose; accordingly, the application is allowed and it is directed that, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand only), with two sureties of Rs. 5,000/- (Rupees Five Thousand only) each, to the satisfaction of the Chief Judicial Magistrate, Coochbehar, and subject to the conditions laid down under Section 438(2) of the Cr.P.C.
Accordingly, CRM (A) 197 of 2026 is allowed.
